Judge Miriam G. Cederbaum of Federal District Court in Manhattan granted
a preliminary injunction motion in Miramax‘s favor last week, ruling
that Columbia Pictures Entertainment and Mandalay Entertainment should
be barred from using misleading ad copy in promoting their successful
film “I Know What You Did Last Summer,” according to Miramax.
The studio had used tag lines such as “from the creator of Scream” and
“last time he made you scream, this time you won’t have the chance” in
advertising for the film which was written by Kevin Williamson, the
writer of Miramax’s “Scream” and “Scream 2.” The Scream films were
directed by Wes Craven, and neither he nor Miramax had anything to do
with the Columbia film or its projected sequels.
According to a statement issued by Miramax, Judge Cederbaum ruled that
even though Craven and Miramax were not involved in “Last Summer,” that
“the central message of Columbia’s and Mandalay’s advertisements is that
‘I Know What You Did Last Summer’ is a desirable product because it
comes from the same source as ‘Scream.'” The judge ordered Columbia and
Mandalay to write all parties involved in the distribution, advertising,
exhibiting and marketing of “Last Summer” to remove all “Scream
catchphrases.” The Miramax release also states that “Last Summer” is
currently in release in dozens of terretories throughout the world and
is set to open in many others.
